Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of justsayhats.com (the “Site”), operated by Howe Media Group LLC under the Just Say Hats name (“Just Say Hats,” “we,” “us,” or “our”).

Acceptance of These Terms

By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About Just Say Hats

Just Say Hats is a hat discovery and content platform. The Site features hats, brands, Collections, Styles, Features, and Stories, and may link you to brands, retailers, and other third-party websites where you can learn more or make a purchase.

Using the Site

You must be at least 13 years old to use the Site. You agree to use the Site only for lawful purposes and in accordance with these Terms. The Site may offer additional features over time — such as accounts, saved hats or searches, alerts, submissions, or comments. If and when any such feature becomes available, your use of it is also subject to these Terms. Purchasing an advertising package requires that you be at least 18 years old and authorized to act on behalf of the business you represent.

Product and Brand Information

Information about hats, brands, and products on the Site may come from brands, manufacturers, retailers, our own research, or other sources, and may change over time. Editorial content and recommendations on the Site are not a guarantee of any product’s quality, suitability, availability, pricing, performance, or accuracy. You are responsible for evaluating whether a product is appropriate for your needs before purchasing it.

Third-Party Websites and Purchases

The Site may link to brand, retailer, and other third-party websites. When a transaction occurs on a third-party site, matters such as payment, shipping, returns, warranties, and customer service are generally governed by that third party’s own terms and policies, not ours. We are not a party to those transactions and are not responsible for the content, accuracy, or practices of any third-party site.

Affiliate Links, Advertising, and Sponsored Content

Just Say Hats may generate revenue through methods that can include affiliate links, advertising, sponsored content or Stories, featured placements, brand partnerships, giveaways, and other commercial relationships. Where sponsored or affiliate content appears, we aim to identify it as such. These arrangements do not obligate us to feature, recommend, or favorably review any particular brand or product, and our use of these monetization methods may change over time as the Site evolves.

Advertising Packages

These terms apply when a business purchases an advertising package from Just Say Hats, in addition to the rest of these Terms.

Packages and payment. Packages, what they include, and their prices are described on our Advertise page at the time of purchase. Each package is a fixed-duration campaign purchased with a single, one-time payment processed by Stripe. Packages are not subscriptions and never renew automatically. Promotional codes, when offered, are subject to their stated terms, cannot be combined, and have no cash value.

When your campaign starts. Your campaign term begins on the date your first agreed promotional placement is published on Just Say Hats, not the date of payment, and runs for the duration of your package (one month for Brand Spotlight, three months for Featured Brand Partner). We'll coordinate timing with you.

Your materials. After purchase, we'll ask for the materials needed for your campaign, such as your logo, product links and images, and brand information. Please provide them within 30 days of our request. We can't begin your campaign until we receive them, and if they don't arrive within 30 days we'll contact you about rescheduling or cancellation. You confirm that you have the rights to everything you provide and that it is accurate and lawful, and you grant Just Say Hats the license described under “Brand and Other Submissions” for your campaign and for any content that remains published afterward.

Editorial control and sponsored content. Just Say Hats retains final editorial control over all published content, including whether, how, and when it appears. You'll have an opportunity to review dedicated brand content for factual accuracy before publication. Editorial features beyond a Brand Spotlight article may be product features, guides, roundups, or other content that includes your brand, and are not necessarily standalone articles about your brand. Paid placements and sponsored content are disclosed as sponsored. We may decline or remove content that doesn't meet our editorial standards or applicable law.

After your campaign. Time-limited placements, such as homepage features, curated promotional placements, and email and social promotion, end when your campaign term ends. Brand pages, Hat listings, and editorial content published during your campaign may remain accessible on the Site afterward, subject to our editorial policies. We do not promise permanent hosting, placement, or availability, and we may update, archive, or remove content at our discretion.

No guaranteed results. We do not guarantee traffic, impressions, clicks, search rankings, sales, conversions, or any other results.

Your website and tracking. Analytics, advertising pixels, and retargeting on your own website are your responsibility, including any consent required by law. We do not place advertiser pixels or tracking tags on Just Say Hats.

Advertising Cancellations and Refunds

• Before production work begins: you may cancel for a full refund. Production work begins when we start preparing your campaign content, such as building your Brand page or Hat listings or drafting your Brand Spotlight.
• After production work begins: refund requests are reviewed case by case, considering the work completed and the circumstances, and any refund may be partial.
• If we can't deliver: if Just Say Hats can't deliver a substantial part of your package, we'll offer a replacement placement or a refund for the undelivered portion.
• How to request: contact us through our Contact page. Approved refunds are returned to your original payment method through Stripe.

Brand and Other Submissions

If you submit brand information, images, or other content to us — including through Feature Your Brand — you represent that you have the right to submit it. You grant Just Say Hats a non-exclusive, royalty-free license to use, reproduce, edit, display, publish, and distribute the submitted material in connection with Just Say Hats, including on the Site, in email communications, and on our social media channels. Submitting material does not guarantee that we will publish it, cover it, or give it any particular placement; we may review, decline, edit, display, publish, or remove submitted material at our discretion. Submitting material to us does not transfer ownership of your underlying brand or intellectual property — you retain ownership, and we retain only the rights described above.

Intellectual Property

The Site’s original content — including Stories, written content, graphics, site design, original photography, branding, and other original materials — is owned by Just Say Hats or its licensors and is protected by applicable law. You may view and share Site content for personal, non-commercial use, but may not copy, reproduce, or redistribute it for other purposes without our permission. Third-party trademarks, product names, logos, images, and other materials that appear on the Site remain the property of their respective owners, and their appearance on the Site does not imply that the brand endorses or is formally affiliated with Just Say Hats unless stated.

Prohibited Uses

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms
• Scrape, harvest, or systematically extract data from the Site without our permission
• Interfere with or disrupt the Site’s operation or security
• Upload or transmit viruses, malware, or other harmful code
• Impersonate any person or entity or misrepresent your affiliation with anyone
• Submit false or misleading brand or product information
• Infringe the intellectual property or other rights of any third party

Normal browsing, sharing, and indexing of the Site is fine — these restrictions are aimed at misuse, not ordinary use.

Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, Just Say Hats will not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or any third-party transaction, product, or website linked from the Site. These limitations apply to the fullest extent permitted by applicable law and do not exclude liability that cannot legally be limited or excluded.

Indemnification

You agree to indemnify and hold Just Say Hats harmless from any claims, losses, or damages arising from your violation of these Terms or misuse of the Site.

Privacy

Our Privacy Policy explains how we collect, use, and protect information when you use the Site, and is incorporated into these Terms by reference.

Changes to the Site or These Terms

We may update the Site or these Terms from time to time. Updated Terms will be posted here with a new effective date, and your continued use of the Site after that point means you accept the changes. We encourage you to review these Terms periodically.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any legal action or proceeding arising out of or relating to these Terms or the Site will be brought in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

General Terms

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force. These Terms, including the Advertising Packages and Advertising Cancellations and Refunds sections, constitute the entire agreement between you and Just Say Hats regarding the Site, superseding any prior agreements on this subject. Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it later.
